For Board & Train program clients, $900 of the initial fee is non-refundable. The remainder of the fee is refundable up until 30 days prior to your dog's drop-off date. If you cancel your Board & Train program within 15-30 days prior to the drop-off date, 50% of the remaining fee will be refundable. If you cancel within 14 days prior to the drop-off date, no refunds will be given.
All training packages and sessions are non-refundable, non-transferable, and must be used within 3 months.
If the trainer feels that the client will not listen to training advice or follow instructions, Bar W Dog Training can, at our sole discretion, choose to cancel the training contract and issue a partial refund.
I hereby authorize the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) without limitation at the discretion of Bar W Dog Training and I specifically waive any right to any compensation I may have for any of the foregoing.
The parties agree as follows:
Boarding Information
If your dog will be with us for Boarding or for a Board & Train program, please provide enough dog food for the amount of time your dog will be staying with us, along with feeding instructions, as well as any medication that your dog may need during his stay and any other special instructions. Dogs requiring daily medication, injections, canned dog food or a raw diet are subject to additional boarding fees. If you use a training collar or a muzzle on your dog, please bring them.
If Bar W Dog Training must provide food for the Client's dog at any point during the stay, a fee of $10 per meal shall apply and will be added to the remaining balance.
All dogs must be dropped off and picked up by the client, unless otherwise discussed.
Waivers
Bar W Dog Training agrees to exercise due and reasonable care, and to keep the kennel premises sanitary and properly enclosed. The pet(s) is (are) to be fed properly and regularly, and to be housed in clean, safe quarters, for this visit and ALL future visits.
Bar W Dog Training will endeavor to create as safe an environment as possible for the training and boarding care of the dog(s) identified above, and will offer only sound, safe, and responsible training, care, and post-boarding/training instructions. The Client agrees, however, that all animals may exhibit unpredictable behaviors and that Bar W Dog Training will not be liable for the actions of the dog that are outside of the control of Bar W Dog Training. The Client agrees that the recommendation by Bar W Dog Training of any product or service is not a guarantee of performance or owner’s satisfaction with that product or service.
The Client specifically represents that the pet has not contracted, nor been exposed to, any contagious disease, including rabies, distemper, parvovirus, H3N2 (K9Flu) or bordatella within a thirty day period
prior to boarding. Client agrees to indemnify and hold Bar W Dog Training harmless against any damages arising from bordetella exposure.
**Dogs must not be vaccinated within a 14 day period prior to boarding with Bar W Dog Training.**
All pets are boarded or otherwise handled or cared for by Bar W Dog Training staff without liability on Bar W Dog Training’s part for loss or damage from disease, natural disaster, theft, fire, death, escape, injury or harm to persons, other pets or property by said pets, or for other unavoidable causes, due diligence and care having been exercised.
The Client acknowledges and agrees that owning any animal, including the dog, has inherent risks, including but not limited to the risk of dog bites to The Client.
The Client fully understands the tools and techniques that are used to train and modify the behavior of their dog and agrees to the tools and techniques including but not limited to prong collar, bark collar,
remote training collar, slip lead, pet convincer, and muzzle.
Client agrees to indemnify and hold Bar W Dog Training harmless from and against any claims of injury, expense, costs, loss or damages caused by the gross negligence or willful misconduct of Bar W Dog Training while the dog is in the sole custody, care and control of Bar W Dog Training. The Client
acknowledges that Bar W Dog Training has no control over the dog when the dog is not in the exclusive custody, care and control of Bar W Dog Training, and The Clientagrees to indemnify and hold Bar W Dog Training harmless from and against any and all claims of injury, expense, costs, loss or damages caused by the actions of the dog when the dog is not in the sole custody, care and control of Bar W Dog Training.
The Client agrees to pay Bar W Dog Training per day per each additional pet for such boarding. The balance will be collected upon the pick-up of the pet(s). Any miscellaneous charges for services desired by The Client will be due upon pick-up as well. The Client further agrees that pet(s) shall not leave the facility until all charges are paid to Bar W Dog Training by The Client.
If the pet(s) become ill, or if the state of the pet’s health otherwise requires professional attention, Bar W Dog Training will attempt to contact The Client. If unable to reach the owner in a timely manner, Bar W Dog Training, in its sole discretion, may engage the services of a veterinarian of its choosing, or administer medicine, or give other requisite attention to the animal, and the expenses thereof shall be paid by The Client.
Your dog will be staying at our home. Your dog spends a good amount of time in the outside world doing lots of things around lots of natural objects, dirt, grass, cement, trees, fencing, bushes, interacting with lots of other dogs, and humans and it is likely that your dog is going to get scratched, bumped, or bruised. Your dog will most likely get some wear
and tear on them. Imagine when you went to summer camp for a few weeks, you get a little banged up from all of the activities. Things are bound to happen even though we have taken special care in preventing them. As the dog owner you acknowledge and understand that there are certain risks involved in pet training, boarding, and care. You release, indemnify, and agree to hold Bar W Dog Training harmless from any and all manner of damages, claims, loss, liabilities, costs or expenses, causes of actions or suits, whatsoever in law or equity, (including, without limitation, attorney’s fees and related costs) arising out of or related to the services provided by Bar W Dog Training.
Waiver of Contractual Right
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
Applicable Law
This Agreement shall be governed by the laws of the State of Texas.
